UPDATE: Lesire World man convicted of assault with a baseball bat

A spokesperson for the Orange County District Attorney’s office said the sentencing hearing for a Leisure World man convicted of misdemeanor assault with a deadly weapon is pending.

According to Farrah Emami, of the OCDA’s Office, David Brian McCabe, 56, did not appear for his scheduled Tuesday, April 2, court hearing. He was apparently arrested on an unrelated charge over the weekend and released on bail.

Emami said that because he did not attend his sentencing hearing, the court has issued a warrant for his arrest.

A Leisure World resident was scheduled to be sentenced on Tuesday, April 2, for misdemeanor assault with a deadly weapon on a neighbor, according to the Orange County Superior Court website. He was convicted on the charge two days after his 56th birthday.

Details of the hearing were not available at press time.

“As for sentencing, he faces a sentence ranging from probation up to one year in jail,“ said Farrah Emami, spokesperson for the Orange County District Attorney’s Office.

She said that because the charge was a misdemeanor, one year in jail is the maximum the law will allow.

According to the Seal Beach Police Department, he poked his neighbor with a baseball bat.

According to occourts.org, David Brian McCabe, 56, was convicted by a jury on March 28.

According to Seal Beach Police Sgt. Ron Lavelle, public information officer for the department, McCabe was arrested for assault with a deadly weapon on Wednesday, Feb. 20. According to Lavelle, the arrest was the result of a dispute between neighbors.

Lavelle confirmed that if McCabe, a resident of Leisure World Mutual 2, had poked his neighbor with anything other than a baseball bat, he would not have been charged with assault with a deadly weapon.

Burglary Report—8:14 a.m.—10th Street—Point of entry: a door pry from the garage to the interior. Loss: tools. The crime occurred between 5 p.m., Tuesday, March 19, and 7 a.m., Wednesday, March 20.

Grand Theft Report—2:18 p.m.—1st Street—Sometime on Monday, March 18, someone took the catalytic converter from the caller’s car. Report taken.

Counseling—4:52 p.m.—Monterey Road, Mutual 2—Leisure World Security was en route to respond to a report of a man taking a golf car that did not belong to him from one parking space and moving it to another. Counseled.

Petty Theft Report—3:40 p.m.—Northwood Road, Mutual Unknown—The crime apparently occurred on Feb. 2. Loss: a ring, valued at $500. Report taken.

Petty Theft Report—11:23 p.m.—St. Andrews Drive, Mutual Unknown—The caller reported $250 missing from where wallet. The money was apparently stolen while she was singing in a program.

Fraud Report—7:57 p.m.—Wentworth Lane, Mutual 5—A Leisure World woman received a call from someone in Florida who said she won a contest. All she had to do was send a check to receive a prize. She sent a check for $489.

This is commonly known as a sweepstakes scam. Legitimate contests don’t issue you a bill for sending you a prize. Report taken.

Saturday, March 23

Suspicious Circumstances—7:26 p.m.—Reagan Street—The caller reported seeing her neighbors’ front light over the garage flashing on and off. The caller said it looked like no one was home and all the lights in the residence were off. There were two cars in the driveway. The caller said the flashing had stopped and was unsure if it was related to an alarm. The caller left the area. Patrol contacted the homeowners and everything checked out OK.

Tuesday, March 26

Shots Heard—1:31 a.m.—Los Alamitos Boulevard—The caller reported hearing two shots and said they saw a flash on the second shot. The caller reported hearing nothing else suspicious. A second caller also reported hearing a loud “boom” in the area of Ganahl Lumber. A third caller also reported hearing what sounded like a shotgun. Patrol contacted workers at nearby company who said that the noises were fireworks and that they had seen the fireworks go up in the air. Everything else checked out OK.

Vandalism—5:01 a.m.—3500 block of Cerritos Ave.—The caller reported that someone broke into the pool area and threw objects into the pool. The caller also reported that the area had been toilet papered and that items had been overturned.

Suspicious Person or Circumstances—1:34 p.m.—Salmon Drive—The caller requested a patrol check for an individual wearing head phones who was handing out pink cleaning cards. The caller said the individual was taking too long to put the cards on doors and thought the individual might be checking door handles.

Burglary Report—11:57 a.m.—The caller reported a vehicle burglary. The caller thought it occurred on Tuesday night, March 26.
